1. Legal notice
In accordance with article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the owner of this website is identified as follows:
- Owner: FundRapido S.L.
- Tax ID (CIF): B88785233
- Registered office: Plaza Gal·la Placídia 11, Puerta 2, 08006 Barcelona (Spain)
- Contact: info [at] fundrapido.es
Nature of the product
FundRapido S.L. is not a credit institution and does not require a licence from the Bank of Spain. Funding is formalised as a cuentas en participación agreement (participation account, articles 239–243 of the Spanish Commercial Code): FundRapido contributes capital to the business and shares in its results. It is aimed exclusively at businesses and professionals: companies (S.L., S.L.U. and S.A.) registered in Spain and sole traders (autónomos) registered in Spain, always for business or professional purposes. It is not consumer credit under Law 16/2011. It is not a bank loan but a cuentas en participación (participation account) agreement. FundRapido is not a CIRBE reporting entity, so the transaction is not reported to CIRBE.
Intellectual property
All content on this site (texts, images, brand, source code) belongs to FundRapido S.L. or its licensors. It may not be reproduced without express permission.
2. Privacy policy
This policy explains what personal data FundRapido S.L. processes, where it comes from, what we use it for, who we share it with and what your rights are. It applies to the fundrapido.es website, funding applications, the client and partner areas, and our relationship with the businesses we fund. It complies with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Digital Rights (LOPDGDD).
2.1 Data controller and contact
- Controller: FundRapido S.L., tax ID B88785233, Plaza Gal·la Placídia 11, Puerta 2, 08006 Barcelona (Spain).
- Privacy contact: info [at] fundrapido.es (subject “Privacy”).
2.2 Who this policy covers
Our clients are companies and sole traders. “Your data” means the data of the individuals connected to the business: the sole trader, directors, shareholders and beneficial owners, signatories, people authorised to act for the business and contact persons. It also covers partners who refer clients to us and anyone who visits the website or writes to us.
If you give us data about other people (for example, other directors or shareholders), you must have informed them of this policy and have a lawful basis to share it with us.
2.3 What data we process and where it comes from
- Data you give us when you apply: name, date of birth, address, email and phone; business data (name, tax ID, legal form, activity, sales, time trading); data on directors, shareholders and beneficial owners; bank statements and any documents you attach. Your ID/NIE is not asked for when you apply: it is verified at the contract stage, through the identity verification provider (KYC).
- Data generated when you use the website and your area: login and account data, preferences, IP address, device and browser data, and security logs. Cookies are explained in the cookie policy.
- Data you give us when you contact us: the content of your emails, forms and messages, and notes from our calls with you.
- Data generated during the funding: the offer, the agreement and its electronic signature, collections and repayments, incidents and complaints.
- Data we obtain from third parties: identity and document checks; sanctions and politically exposed persons (PEP) lists; public registers (Mercantile Register, BORME); credit and solvency files; and, if you authorise them, read-only connections to your bank or sales platforms. These connections cannot move money or change anything in your accounts.
- Data a partner gives us: if a partner (for example, your accountant) refers you or prepares your application, they give us the data you have authorised them to share.
We do not ask for special categories of data (health, beliefs, etc.). Some data is needed to assess the application and comply with the law: without it we cannot offer you funding.
2.4 What we use your data for and on what legal basis
| Purpose | Legal basis |
|---|---|
| Assessing your application and preparing the offer | Pre-contractual steps at your request (art. 6.1.b GDPR) |
| Signing and managing the agreement: paying out the amount, collecting the agreed share of your sales, recovering outstanding amounts and customer service | Performance of the contract (art. 6.1.b) |
| Verifying identity and beneficial ownership and preventing money laundering and terrorist financing | Legal obligation (art. 6.1.c; Spanish Law 10/2010) |
| Meeting accounting and tax obligations and responding to authorities | Legal obligation (art. 6.1.c) |
| Preventing fraud and protecting the security of the website and accounts | Legitimate interest (art. 6.1.f) |
| Checking credit files and public registers to assess risk | Legitimate interest (art. 6.1.f; art. 20 LOPDGDD) |
| Managing the relationship with the partner who referred you: telling them the status of your application and calculating their commission | Legitimate interest (art. 6.1.f) and, where needed, your consent |
| Analysing use of the website and improving our services | Legitimate interest (art. 6.1.f); consent for non-essential cookies |
| Sending you marketing about our products | Consent (art. 6.1.a) or, if you are already a client, legitimate interest for similar products (art. 21.2 LSSI-CE). You can unsubscribe in every message |
| Defending our rights in claims | Legitimate interest (art. 6.1.f) |
You can object at any time to processing based on legitimate interest (see 2.8).
2.5 Who we share your data with
- Providers working on our behalf (processors), under contract and only with the data they need: hosting and cloud, email and messaging, electronic signature, identity verification and anti-money-laundering (KYC/AML), read-only bank connections (open banking), collections and payments, web analytics and customer support.
- Banks and payment institutions involved in paying out the amount and collecting the agreed share of your sales.
- Credit and solvency files (for example, ASNEF or RAI) where the law allows.
- The partner who referred you or prepared your application: the status of the application and, if it is funded, the data needed to calculate their commission. We do not share your statements or documents with them.
- Authorities and public bodies where required by law: SEPBLAC, the Spanish Tax Agency, the AEPD, courts, and law enforcement.
- Professional advisers (auditors, lawyers) bound by confidentiality.
- Investors or buyers in a corporate transaction (merger, sale, portfolio funding), with appropriate safeguards.
We do not sell your data. The current list of providers is available on request from the privacy contact.
2.6 Automated decisions (art. 22 GDPR)
The initial eligibility check (legal form, time trading and minimum sales) is automatic, based on the data you enter. The decision to offer you funding and its terms is always reviewed by a person on our team. In any case, you have the right to an explanation of the logic used, to request human intervention, to express your point of view and to challenge the decision by writing to the privacy contact.
2.7 How long we keep your data
- For as long as our relationship lasts and, afterwards, for the limitation periods of any resulting claims (generally 5 years; art. 1964 Spanish Civil Code).
- Identification and anti-money-laundering data: 10 years after the relationship ends (Law 10/2010).
- Accounting and tax data: 6 years (art. 30 Spanish Commercial Code) or as required by tax law.
- Applications not approved or not signed: 3 years, on legitimate interest, to handle claims and prevent fraud.
- Marketing: until you withdraw your consent or object.
After these periods, we block the data as required by art. 32 LOPDGDD and delete it once it is no longer needed.
2.8 Your rights
You can exercise at any time your rights of access, rectification, erasure, restriction of processing, portability and objection, withdraw your consent without affecting earlier processing, and not be subject to decisions based solely on automated processing. Write to info [at] fundrapido.es (subject “Privacy”) with your name and the right you want to exercise. We only ask for extra documents if there is reasonable doubt about your identity. We reply within one month, extendable by two more months for complex requests, and we tell you in advance.
Some rights have legal limits: for example, we cannot erase data the law requires us to keep.
If you believe we have not handled your rights properly, you can complain to the Spanish Data Protection Agency (AEPD). We would appreciate it if you wrote to us first so we can try to resolve it.
2.9 International transfers
We process your data in the European Union whenever possible. If a provider accesses it from outside the European Economic Area, we only do so to countries with a European Commission adequacy decision or under standard contractual clauses approved by the Commission, with additional measures where needed. You can ask the privacy contact for a copy of these safeguards.
2.10 Security
We apply technical and organisational measures appropriate to the risk: encrypted connections, role-based access control, two-step verification for our team, activity logs, and read-only access for connections to your accounts. More detail in Security & data.
2.11 Minors
Our services are aimed at companies and sole traders. We do not knowingly process data of people under 18.
2.12 Changes to this policy
We may update this policy. The date of the latest version appears at the top of this page and, if the change is significant, we will tell you by email.
